Google privacy saga concerning right to obivion continues with the measure of Italian Persona Data Protection Authority n. 557 dated December 21st, 2017 concerning the remova of certain Url from the list of European and non-European results of the widely-known search engine. It is very interesting the fact that the data subject is an Italian citizen resident outside Europe, asking for the de-indexing at global level and not limited to EU websites.
The Authority partially accepted the appeal, taking into consideration that in order to make effective the protection of a data subject resident outside EU it is necessary to extend the removal of Url also to non-EU versions of the search engine, and therefore imposing to the de-indexing both in Eu and non-EU versions, extending such activity also to Url already de-indexed in Google EU sites.
The case appears very similar with “Google Spain” (C-131/12 EU CoJ) and “Google France” (still pendig before EU CoJ).
