After a long consultation, on the 25th of January 2012, the Commission published the first draft of the proposal for a Regulation on the protection of individuals with regard to the processing of their personal data and on the free movement of such data (General Data Protection Regulation).

The ordinary legislative procedure is still pending. The Regulation is currently being negotiated in the second reading by the European Parliament and Council. A common position on the final text is expected by mid 2016.

After publication on the Official Journal of the European Union, pursuant to art. 91 of the Regulation, a two year transitional period will apply. At the end of this period the Regulation will be directly applicable in every EU Member state, without requiring implementation through national law.
