On 25 October the Delegation to the Government for the transposition of European directives and the implementation of other European Union acts (European delegation law 2016-2017) was issued. The regulatory adjustment will be based on the following principles:
a) to repeal expressly the provisions of the Code concerning the processing of personal data, as per Legislative Decree no. 196, incompatible with the provisions contained in Regulation (EU) 2016/679;
b) modify the code referred to in Legislative Decree no. 196, only to the extent necessary to implement the non-directly applicable provisions contained in Regulation (EU) 2016/679;
(c) to coordinate existing provisions on the protection of personal data with the provisions of Regulation (EU) 2016/679;
(d) to provide for, where appropriate, the use of specific implementing and supplementary measures adopted by the Guarantor for the protection of personal data in the scope and for the purposes set out in Regulation (EU) 2016/679;
(e) to adapt, as part of the changes to the code referred to in Legislative Decree no. 196, the criminal and administrative sanctioning system in force under the provisions of Regulation (EU) 2016/679, with penalties and administrative penalties effective, dissuasive and proportionate to the seriousness of the breach of the provisions.
The measure will enter into force on 21/11/2017 and the Government will have 6 months to adjust accordingly by 22/05/2018.
